Terms of Service

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By using the Site you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Products and Pricing

We make reasonable efforts to display product descriptions, images, ingredients, and prices accurately, but we do not warrant that the content on the Site is error-free. Colors and packaging may vary slightly from images shown.

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing or description errors, limit order quantities, and refuse or cancel any order at our discretion, including after an order has been submitted.

3. Orders and Payment

Your order is an offer to buy. We accept your offer when we send an order confirmation. Payment is processed at checkout through Shopify and its payment processors. By submitting an order you authorize us (and our processors) to charge your selected payment method for the order total, including taxes and shipping.

We may cancel orders that we suspect are fraudulent, mispriced, or that violate these Terms.

4. Shipping

Shipping times and costs are estimates and are not guaranteed. Risk of loss and title for products pass to you upon our delivery to the carrier. We are not responsible for carrier delays, lost packages once delivered to the address you provided, or duties and taxes for international orders.

5. Returns and Refunds

For return eligibility, timeframes, and instructions, contact us at marketing@prefense.com. Products must be unused and in original packaging unless they arrived damaged or defective. Refunds are issued to the original payment method after we receive and inspect the return.

6. Product Use and Safety

Prefense products are for external use only. Read and follow all label directions and warnings. Discontinue use and consult a healthcare professional if irritation occurs. Keep out of reach of children. Our products are not drugs and are not intended to diagnose, treat, cure, or prevent any disease.

7. Intellectual Property

The Site and all content on it — including text, graphics, logos, product names, images, and software — are owned by or licensed to PREFENSE LLC and are protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent. "PREFENSE" and related marks are trademarks of PREFENSE LLC.

8. User Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any portion of the Site or our systems.
• Interfere with the Site's operation, security, or other users' use.
• Use automated means (bots, scrapers, crawlers) without our written permission.
• Resell our products without our prior written authorization.

9. User Submissions

By submitting reviews, photos, comments, or other content to us or through the Site, you grant PREFENSE LLC a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, reproduce, modify, publish, and display that content in connection with our business. You represent that you own or have the rights to submit the content and that it does not violate any third-party rights or applicable law.

10. Third-Party Links and Services

The Site may contain links to third-party websites or services (including Amazon and Shopify) that we do not control. We are not responsible for the content, policies, or practices of those third parties. Your dealings with them are solely between you and them.

11. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, PREFENSE LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PREFENSE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless PREFENSE LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your misuse of the Site or products, or your violation of any law or third-party right.

14. Governing Law and Venue

These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of Iowa, without regard to its conflict-of-laws principles. You agree that the exclusive jurisdiction and venue for any action arising out of or related to these Terms shall be the state and federal courts located in Iowa, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

16. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and PREFENSE LLC regarding your use of the Site and supersede any prior agreements.
